Reference | Real estate dispute in the District Court

We assisted a shopping centre in a district court dispute concerning the interpretation of a contract in a real estate matter. The case concerned the opposing party’s claim that it had a gratuitous right of use to certain premises located in the shopping centre’s building and that it was not obliged to pay rent for its own use. In addition, the opposing party requested that the shopping centre’s legal costs be reduced on grounds of reasonableness.

The district court dismissed the claim in its entirety and ordered the claimant to fully compensate the shopping centre for its legal costs. The court held that there were no grounds for reducing the legal costs and that there was no basis for reducing the billed working hours, which the court characterised in their entirety as exemplary legal assistance.
